Fatmir Mediu rejects Appeal’s verdict to reopen the Gerdec trial: Unconstitutional

Former defense minister Fatmir Mediu is opposing the verdict of the Appeal Court to reopen the Gerdec case, calling it an “unconstitutional act” that violates “the European Convention on Human Rights”.

“The ruling constitutes absolute invalidity, and in case, its motivational bases cannot be the law. It is the first time in the history of jurisprudence that a judge of the lowest instance annuls the verdict of the High Court”, said among other his attorney Ardian Visha.

He also emphasized that the ruling violates the law, hinting at double jeopardy since the same case was tried and dismissed by the First Instance Court and the Tirana Appeal Court in 2019.

According to Mediu’s attorney, the ruling undermines principles of juridical security, and it aims to “launch a proceeding on an indictment whose legal deadlines have long expired”.

Visha also underlined that the defendant will use every legal means after being more acquainted with the legal reasoning behind the verdict.
