Amnesty International expressed<\/strong><\/a> concern again on Monday about the agreement between Italy and Albania regarding migrants originating from countries in North Africa, which envisions their stay in Albanian territory pending the review of asylum requests. While the protocol between the two countries began discussions on Monday in the Chamber of Deputies, the well-known human rights organization called on Italian parliamentarians to oppose it.<\/p>\n

The agreement, signed on November 6 of last year in Rome between Italian Prime Minister Giorgia Meloni and Albanian Prime Minister Edi Rama, envisions the establishment of two centers, the first in Sh\u00ebngjin where verification procedures for migrants will be carried out, and the second in Gjad\u00ebr, where they will be held in isolation until the completion of asylum acceptance or rejection procedures.<\/p>\n

According to Amnesty International\u2019s statement, \u201cthe scheme to build migrant detention centers in Albania is part of a broader international trend to move border control and asylum processing to third countries: a move that threatens the rights of migrants and refugees and could lead to greater suffering\u201d.<\/p>\n

Matteo de Bellis, a researcher for Migration and Asylum at the organization, believes that \u201cthis agreement represents yet another shameful attempt by Italy to circumvent international and EU law, with possible severe consequences for people seeking asylum\u201d. According to him, \u201cthis unworkable, harmful, and unlawful proposal would see people in distress subjected to long and unnecessary transfers by sea and ending up in automatic and potentially prolonged detention, in violation of international law\u201d.<\/p>\n

According to the protocol between the two countries, migrants captured in open sea will be transferred to Albania. \u201cWith hundreds of miles between the central Mediterranean, where most crossings and shipwrecks occur, and Albania, the agreement patently breaches Italy\u2019s obligation to disembark people rescued at sea as promptly as possible following their rescue. It may also weaken the wider search and rescue system, which would likely jeopardize the safety of people in need of rescue at sea,\u201d Amnesty International emphasizes.<\/p>\n

According to the agreement, Albania only offers its territory, while responsibility, including jurisdiction over the two centers, remains solely with Italy. \u201cWhile the application of Italian jurisdiction appears to promise access to procedural guarantees and asylum rights in accordance with Italian and EU law, in reality access to such guarantees could be severely hampered,\u201d Amnesty notes. According to the organization, \u201call individuals brought to the centers in Albania, including asylum seekers, would be automatically detained. Automatic detention is inherently arbitrary and therefore illegal. Combined with recent changes in Italian law, the agreement could lead to people being detained continuously for more than 18 months\u201d.<\/p>\n

The human rights organization\u2019s statement comes as the text of the agreement was preliminarily examined on Monday in the Chamber of Deputies of the Italian Parliament. The vote is expected in the coming days. \u201cRather than ratifying this harmful agreement, Italian MPs should support measures to ensure adequate reception in Italy, access to an effective asylum procedure, and safe, regular access routes, particularly for people seeking international protection,\u201d concludes Amnesty International.<\/p>\n

Italian Prime Minister Meloni, coming from the nationalist right, rose to power promising to curb migration, but in fact, arrivals increased. The Italian opposition raised many questions about the agreement and strongly opposes it, emphasizing the risk of violating international norms and conventions, as well as the potential harm of this act.<\/p>\n

In Albania, the opposition has also expressed serious concerns. According to them, the agreement is considered to have elements that go beyond a document between two governments, and as a result, authorization from the President of the Republic should have been sought. The recognition of Italian jurisdiction over the territory where the centers will be established is seen as a threat to sovereignty and territorial integrity.<\/p>\n

Precisely for these issues and claims that the protocol between the two countries contradicts international conventions to which Albania is a party, 28 right-wing deputies have turned to the Constitutional Court. In December, this Court decided to suspend the ratification procedures in Parliament. The case is being judged behind closed doors based solely on the documentation. After last week\u2019s session, the Court may come up with a decision in the next session.<\/p>\n","protected":false},"excerpt":{"rendered":"
