The chairman of the Democratic Party, Sali Berisha, has been released from house arrest after a recent decision of the Special Court.<\/p>\n
This decision was taken by judge Flojera Davidhi, who assessed that the conditions and criteria for the implementation of this security measure no longer exist.<\/p>\n
In a statement to the media, Berisha’s lawyer, Genc Gjokutaj, stated that with today’s decision, the former prime minister is free and there is no security measure on him.<\/p>\n
“On the basis of our request, today the court revoked the measure of house arrest as a measure that has neither criteria nor conditions for its assignment. As of today, Sali Berisha is free and without any security measures against him. There is no other security measure,” said Gjokutaj.<\/p>\n
We remind that in a decision taken a few years ago, the Constitutional Court assessed as legal the actions of SPAK (Prosecutor\u2019s Office) not to obtain authorization from the Assembly for the appointment of the “Compulsory appearance” measure.<\/p>\n
While the measure of “Prohibition to leave the country, was abolished by the Constitutional Court due to the lack of proportionality”.<\/p>\n
Failure to comply with the “Compulsion to appear” measure led the GJKKO(Special Court against Corruption) to toughen the coercive measure against Berisha, placing him under “House Arrest”.<\/p>\n
Sali Berisha and his son-in-law, Jamarb\u00ebr Malltezi, have been charged by SPAK in relation to the privatization of the sports grounds of the Football Club and the “Partizani” Multi-Sports Club.<\/p>\n
