{"id":80571,"date":"2025-10-01T17:06:20","date_gmt":"2025-10-01T15:06:20","guid":{"rendered":"https:\/\/euronews.al\/en\/?p=80571"},"modified":"2025-10-01T19:07:20","modified_gmt":"2025-10-01T17:07:20","slug":"early-elections-in-6-municipalities-on-november-9-presidency-clarifies-decree-for-tirana","status":"publish","type":"post","link":"https:\/\/euronews.al\/en\/early-elections-in-6-municipalities-on-november-9-presidency-clarifies-decree-for-tirana\/","title":{"rendered":"Early Elections in 6 Municipalities on November 9 \u2013 Presidency Clarifies Decree for Tirana"},"content":{"rendered":"<p class=\"p1\"><span class=\"s2\">President of the Republic, <\/span><span class=\"s1\">Bajram Begaj<\/span><span class=\"s2\">, decreed Wednesday, <\/span><span class=\"s1\">November 9, 2025<\/span><span class=\"s2\">, as the date for holding early local elections in six municipalities, including <\/span><span class=\"s1\">Tirana<\/span><span class=\"s2\">.<\/span><\/p>\n<p class=\"p1\"><span class=\"s2\">In its press release, the Presidency also clarified the reasoning behind declaring early elections for the mayor of Tirana, despite the fact that former mayor <\/span><span class=\"s1\">Erion Veliaj<\/span><span class=\"s2\"> had appealed his dismissal to the Constitutional Court.<\/span><\/p>\n<p class=\"p1\"><span class=\"s2\">According to President Begaj, appeals against dismissal due to <\/span><span class=\"s1\">absence from duty<\/span><span class=\"s2\"> \u2014 such as Veliaj\u2019s case \u2014 do not fall under the jurisdiction of the Constitutional Court, but under the <\/span><span class=\"s1\">Administrative Court<\/span><span class=\"s2\">. In the absence of such an appeal or a suspension ruling, the process cannot be halted, the Presidency emphasized.<\/span><\/p>\n<p class=\"p1\"><span class=\"s2\">The statement added that even in these cases, suspension of a dismissal decision may only be ordered by the Administrative Court.<\/span><\/p>\n<p class=\"p3\"><span class=\"s2\">\u201cFor reasons of high public interest, the Presidency clarifies that, regarding the vacancy in Tirana, the President reviewed the legality of the procedure followed and confirmed that the declaration of the vacancy was made at the conclusion of a verification process carried out by the Tirana Municipal Council and the Council of Ministers. The President does not assess the merits of the case but ensures institutional neutrality,\u201d the statement read.<\/span><\/p>\n<p class=\"p3\"><span class=\"s2\">The Presidency further noted that under Albanian law, dismissal for <\/span><span class=\"s1\">\u201cfailure to appear at work for a continuous 3-month period\u201d<\/span><span class=\"s2\"> is a different legal basis than dismissal for <\/span><span class=\"s1\">\u201cserious violations of the Constitution or laws\u201d<\/span><span class=\"s2\">, which falls under Constitutional Court jurisdiction. Hence, Veliaj\u2019s case can only be reviewed by the Administrative Court.<\/span><\/p>\n<p class=\"p3\"><span class=\"s2\">It was also underlined that the Council of Ministers\u2019 dismissal decision (VKM no. 539, dated September 25, 2025) was already public with the accompanying legal explanations, and no appeal was filed within the required timeframe. The President\u2019s constitutional deadline to announce elections is only 48 hours after being notified of a vacancy.<\/span><\/p>\n<p class=\"p3\"><span class=\"s2\">With the decree now issued, the Presidency stressed that <\/span><span class=\"s1\">legal remedies remain available<\/span><span class=\"s2\"> for the parties involved to pursue their rights.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Background:<\/span><\/p>\n<p class=\"p1\"><span class=\"s2\">Erion Veliaj was dismissed from office for failing to appear at work for over three months. He has called the decision unlawful and filed to the Constitutional Court, arguing that his absence was due not to negligence, but to physical impossibility.
