The decision was reached by a majority vote of 5 to 3 and has been described as one of the fastest rulings delivered by this institution in recent years.<\/p>\n<p>According to the announced verdict, the Court struck down as unconstitutional the government\u2019s decision to dismiss Veliaj, emphasizing that the executive branch cannot create new legal norms that undermine the principle of local self-governance. The judicial panel argued that the Law on Local Self-Governance does not stand above the Constitution and that Article 115 of the Constitution takes precedence over any provision of ordinary law.<\/p>\n<p>The Court further assessed that the proceedings conducted in the Tirana Municipal Council were irregular and that Veliaj should have been physically present at that meeting. With this decision, the Court also annulled President Bajram Begaj\u2019s decree calling for new local elections in Tirana, confirming that Erion Veliaj continues his current mandate as Mayor of Tirana.<\/p>\n<p>Voting in the Constitutional Court:<\/p>\n<p>In favor of the decision supporting Veliaj:<\/p>\n<ul>\n<li>Sander Beci<\/li>\n<li>Ilir Toska<\/li>\n<li>Fiona Papajorgji<\/li>\n<li>Marsida Xhaferllari<\/li>\n<li>Mariana Semini<\/li>\n<\/ul>\n<p>Against the decision:<\/p>\n<ul>\n<li>Holta Za\u00e7aj<\/li>\n<li>Sonila Bejtja<\/li>\n<li>Gent Ibrahimi<\/li>\n<\/ul>\n<p>This ruling concludes one of the most debated legal and political battles of recent months, paving the way for Erion Veliaj to continue performing his duties as Mayor of Tirana.<\/p>\n<p>Official Court Decision<\/p>\n<p>On November 3, 2025, the Constitutional Court reviewed the case filed by Erion Veliaj, requesting the annulment of Decision No. 539\/2025 of the Council of Ministers regarding his dismissal from the position of Mayor of Tirana; the annulment of Presidential Decree No. 350\/2025 setting the date for partial local elections for mayor, insofar as it pertains to the Municipality of Tirana; and the suspension of the effects of this decree.<\/p>\n<p>The Court unanimously found that it has jurisdiction to review Decision No. 539\/2025, as Article 115, paragraph 2, of the Constitution grants it the competence to examine the dismissal of a directly elected local government body. This competence is intended to safeguard the principle of local autonomy and the right to elect and to be elected.<\/p>\n<p>According to Article 115, paragraph 1, of the Constitution, the dismissal of a directly elected body of local government is a constitutional concept. The Court also noted that in its prior jurisprudence it has excluded from constitutional jurisdiction only cases of mandate termination under Articles 6\/1 and 179\/1 of the Constitution (decriminalization process), while in all other dismissal cases, including this one, it has accepted jurisdiction to review appeals against Council of Ministers decisions dismissing directly elected local government officials.<\/p>\n<p>The Court reiterated that what the Constitution does not state explicitly cannot be implied by law, as this would risk limiting, by statute, the constitutional guarantees afforded to elected local bodies\u2014thus effectively restricting the Court\u2019s own constitutional competence. The Court affirmed that it is the sole authority empowered to determine the constitutionality and legality of government decisions dismissing directly elected officials.<\/p>\n<p>Regarding the applicant\u2019s claims, the Court examined them on their merits within the framework of due process as it relates to dismissal, except for the claim of the presumption of innocence, which was dismissed. The Court emphasized that its review concerned only the administrative dismissal process, not any ongoing criminal proceedings involving the applicant.<\/p>\n<p>Having accepted jurisdiction over Decision No. 539\/2025, the Court, based on its jurisprudence, reviewed the dismissal as a substantive matter of fact and law\u2014analyzing both the constitutionality and legality of the procedure and the act itself. It assessed whether the grounds for dismissal constituted a serious violation of the Constitution or the law, and whether the Council of Ministers had properly justified and motivated its decision.<\/p>\n<p>The Court found that Article 62 of Law No. 139\/2015 merely elaborates on Article 115, paragraph 1, of the Constitution. This constitutional provision does not authorize the legislature to introduce additional grounds for dismissal beyond those explicitly defined\u2014namely, serious violations of the Constitution or the law. On this point, three judges maintained that all provisions under letters \u201ca\u201d, \u201cb\u201d, and \u201cc\u201d of Article 62 of Law No. 139\/2015 were enacted under a legitimate constitutional delegation of Article 115.<\/p>\n<p>By majority vote, the Court concluded that the procedure followed by the Municipal Council and subsequently by the Council of Ministers failed to guarantee the applicant\u2019s right to due process, as he was not properly notified or given the opportunity to be heard and to defend himself.<\/p>\n<p>The Court underscored that due process requires the fulfillment of procedural safeguards for the individual, which are binding obligations for public authorities conducting the process and cannot be shifted onto the individual. Merely informing the person of the meeting date does not absolve the public body from its full procedural responsibilities.<\/p>\n<p>Likewise, the Court determined\u2014by majority vote\u2014that the Council of Ministers, in dismissing the applicant pursuant to Article 62(c) of Law No. 139\/2015, failed to justify that the dismissal was based on serious violations of the Constitution or the law for which he could be held responsible. The Court emphasized that protecting the public interest and voters\u2019 right to be governed by a directly elected body cannot justify the infringement of constitutional guarantees.<\/p>\n<p>For these reasons, the Court, by majority vote, ruled that the applicant\u2019s right to due process in relation to the dismissal measure was violated, and therefore annulled Decision No. 539\/2025 of the Council of Ministers.<\/p>\n<p>Regarding the Presidential Decree, the Court stated that since the review of the dismissal of a local government official under Article 115, paragraph 2, falls within constitutional jurisdiction, the review of subsequent acts derived from that dismissal\u2014such as the President\u2019s decree setting new election dates\u2014also falls under the same jurisdiction. Consequently, the Court found that it was not necessary to exhaust administrative court remedies under Article 131, paragraph 1(f) of the Constitution.<\/p>\n<p>By annulling Decision No. 539\/2025, and in order to remedy the effects of the Presidential Decree setting the election date for the Municipality of Tirana under Article 115, paragraph 3, the Court also annulled this decree as it was issued solely to fill the vacancy created by the unconstitutional dismissal.<\/p>\n<p>Final Ruling<\/p>\n<p>For the reasons above, the Constitutional Court decided, by majority vote, to:<\/p>\n<ul>\n<li>Accept the application.<\/li>\n<li>Annul Decision No. 539, dated 25.09.2025, of the Council of Ministers \u201cOn the dismissal of the Mayor of Tirana, Mr. Erion Veliaj,\u201d as incompatible with the Constitution of the Republic of Albania.<\/li>\n<li>Annul Presidential Decree No. 350, dated 01.10.2025, \u201cOn setting the date for partial local elections for mayor in certain local government units,\u201d insofar as it sets an election date for the Municipality of Tirana, as incompatible with paragraphs 2 and 3 of Article 115 of the Constitution.<\/li>\n<li>Maintain the suspension of Presidential Decree No. 350, dated 01.10.2025, for the portion concerning the Municipality of Tirana, until this ruling enters into force.<\/li>\n<\/ul>\n<p>The final reasoned decision will be published within the legal time limits established by Law No. 8577, dated 10.02.2000, \u201cOn the Organization and Functioning of the Constitutional Court of the Republic of Albania,\u201d as amended, and by the Court\u2019s Rules of Procedure.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Constitutional Court has issued its final decision today regarding the case of suspended Mayor of Tirana, Erion Veliaj, ruling in his favor and allowing him to continue his mandate as Mayor of Tirana.
