{"id":83621,"date":"2026-03-30T19:12:01","date_gmt":"2026-03-30T17:12:01","guid":{"rendered":"https:\/\/euronews.al\/en\/?p=83621"},"modified":"2026-03-30T19:46:50","modified_gmt":"2026-03-30T17:46:50","slug":"appointment-of-cec-members-constitutional-court-declares-osmanis-request-inadmissible","status":"publish","type":"post","link":"https:\/\/euronews.al\/en\/appointment-of-cec-members-constitutional-court-declares-osmanis-request-inadmissible\/","title":{"rendered":"Appointment of CEC members, Constitutional Court declares Osmani\u2019s request inadmissible"},"content":{"rendered":"<p>The Constitutional Court has declared inadmissible the request of the President of Kosovo, Vjosa Osmani, regarding the appointment of members of the Central Election Commission (CEC).<\/p>\n<p>Osmani had requested an assessment of a \u201cconflict between constitutional competencies under Article 113\u201d of the Constitution\u2014specifically between herself and \u201cparliamentary groups as bodies of the Assembly of Kosovo\u201d in relation to the appointment of CEC members.<\/p>\n<p>The Court stated that the required constitutional criteria for raising a \u201cconflict of constitutional competencies\u201d had not been met.<\/p>\n<p>The Constitutional Court explained that, in this specific case, the alleged conflict of competencies was based on a power of the president that is not defined by the Constitution, but rather by the Law on General Elections.<\/p>\n<p>The Court also noted that within the Constitution\u2014particularly in the sections concerning the form of governance and the separation of powers\u2014there is no provision that explicitly grants the President of Kosovo the authority to appoint members of the CEC.<\/p>\n<p>\u201cIn the Court\u2019s assessment, under the circumstances of this case, although the President of the Republic is an authorized party to raise issues of conflict of constitutional competencies between herself and the Assembly, she has not brought before the Court a conflict of \u2018constitutional competencies.\u2019 Consequently, the Court declares the request of the President of the Republic of Kosovo inadmissible,\u201d the ruling stated.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Constitutional Court has declared inadmissible the request of the President of Kosovo, Vjosa Osmani, regarding the appointment of members of the Central Election Commission (CEC).
