Ledio Braho from CAS: The verdict invalidating the elections requires 4 votes in favor

Ledio Braho, member of the Commission of Appeals and Sanctions said on Ilva Now that until now, CAS has rejected 3 requests made by SMI and DP, regarding the administration of proofs that according to them would prove that the parliamentary elections of April 25th were manipulated.

According to Braho, article no. 137 of the Electoral Code, gives the different parties the right for CAS to administer the proofs that the parties aren’t able to secure and the verdict can be reached with the majority of votes in favor, from the 5 members of the CAS.

However, in order to nullify the electoral results in a certain district, like DP and SMI have requested, the law allows this verdict to be reached with only 4 votes in favor.

“In order to nullify the elections, one needs 4 votes in favor, 3 against 2 isn’t enough,” said Braho.

He also stated that the parties have submitted certain evidence and they are asking CAS to secure other evidence because they only had 5 days to appeal the electoral results and this wasn’t enough time for them to secure enough proof.

SMI candidate in the district of Berat, Ardit Cela claimed that in many voting stations there are major inconsistencies in the reported numbers.

According to him, if CAS will come to a verdict that isn’t politically influenced, then SMI should be getting an extra mandate in Berat.

“From our assessments, we have witnessed serious violations and inconsistencies. In many ballot boxes, there are more votes than are written in the report papers. We have seen 24 voting stations and major inconsistencies have been witnessedd,” he said.

Greta Meta, from the Society for Democratic Culture stated during Ilva Now, that she has noticed that until now, SMI has been submitting evidence, whereas DP is presenting more general claims.
