This Monday, the High Judicial Council is holding the hearing session for the disciplinary proceeding requested by the High Inspector of Justice, Artur Metani against magistrate Enkeleda Kapedani.

During his word, Metani stated that under the existing circumstances, the legal provisions are all there to determine the preliminary measure of suspension from her current post and duties, of magistrate Enkeleda Kapedani, at least until the conclusion of her disciplinary proceeding.

According to Metani, if the magistrate continues to serve in her current position as Chief Justice of Elbasan, she will discredit the figure and position of the magistrate.

Juge Kapedani was present in KLGJ’s meeting and made a public apology for the published content while adding that she is an honorable judge that has never committed a corruptive act or violated her powers.

“I am starting my defense by making a serious public apology. I have waited a long time to come before you. I am a dignified judge; I have never committed any corruptive acts or violations.

I am a mother of two children, I work long hours that can reach up to 15 court session per day. I have taken pictures of myself in the office but because of my fatigue and stress during my work, I was judged during a public trial giving me the judgment of the guillotine,” stated the Judge, while tearing up.

At the end of her word, judge Enkeleda Kapedani gave her resignation as top judge of the Court of Elbasan.

In the document procured by Euronews Albania through journalist Merin Maçi, the High Inspector of Justice argues that Judge Kapedani has breached the Constitution, the Law on the Status of Judges and Prosecutors, as well as the Code of Judicial Ethics on the clauses regarding integrity, proper conduct and self-restraint.

This disciplinary probe was ordered by the head of ILD, Artur Metani following the posts made by Judge Kapedani on the social network Tik Tok, which have now gone viral. The posts consist in several selfie-style videos that are accompanied by the Judge’s inappropriate behavior as well as unfitting background music.

This case has caused a lot of backlashes in the public sphere, with many claiming a violation of the Code of Ethics and others protesting the lack of authority shown by the vetting and selection process for high posts like Chief Justices and magistrates.
