Albania and the United Kingdom have signed a joint deal over the transferal of prisoners to their countries of origin.
This agreement, which foresees the relocation of Albanian prisoners from the UK and vice versa, was signed by the minister of justice, Etilda Gjonaj, during her visit in London earlier this Monday.
According to this deal, after being transferred, prisoners are expected to complete the rest of their sentence in their country of origin.
The main issue lies in the differences in transferal procedures in the Albanian and British systems.
In British law, this transferal only involves an administrative process that is followed by the “National Offender Management Services” and there is no need for a court order. Instead, the inmate simply continues to serve his or her remaining time in prison.
In Albania, the process is judicial as well as administrative. The ‘Code of Criminal Procedure” in Albania foresees and regulates the conversion of the sentence, with the exception of cases, where there’s been a prior deal.
