Venice on June 30, 2019: The Constitutional lacks competence to assert electoral legitimacy

Tomorrow, the Venice Commission is bound to publish its final standing in regards to the legitimacy of the Albanian municipal elections that took place on June 30, 2019.

This official assessment was requested from them by the Constitutional Court, which after having reviewed the lawsuit filed by the National Association of Municipalities, presented the Venice Commission with 3 questions.

The Commission’s final report is said to include amongst other things, the viewpoint that the Constitutional Court lacks the competency to make a judgment regarding the legitimacy or lack thereof, of the 2019 municipal elections.

Back in June, the Constitutional Court sent a formal request to Venice, in regards to the disputed final results of the 2019 local elections in Albania, which were held without the participation of the opposition. Democratic MPs had relinquished their mandates and deserted their seats in Parliament, as a sign of protest against the Socialist-led government.

The lawsuit presented to the Constitutional Court was filed by the Association of Municipalities, led at the time by the mayor of Shkodra, Voltana Ademi, who asked to have these elections nullified.

The Constitutional asked to have an official opinion from the Venice Commission, arguing that the issue of proclaiming these elections invalid represented a unique case in the history of the Albanian justice system, which is was prompted them to ask for a more specialized and professional opinion.
