Prosecution Office’s request for “arrest measure”, Constitutional Court dismisses Berisha

The Constitutional Court has rejected the request of several Democratic Party deputies to declare Prosecution Office’s (SPAK) request for Berisha’s arrest unconstitutional.

The lawsuit was signed by 30 DP deputies, among them Gazment Bardhi, while Berisha himself did not sign the lawsuit of the “Reestablishment” group.

Two days ago, Oerd Bylykbashi, Ivi Kaso and Franci Nuri, representatives of the Reestablishment Group, filed a lawsuit in the Constitutional Court regarding the “conflict of powers between the Judiciary and the Legislative power for the immunity of deputies”.

The Special Court of First Instance for Corruption and Organized Crime 2 months ago imposed a measure of “compulsion to appear” and “prohibition of exiting the country” also for former Prime Minister Sali Berisha on the charge of passive corruption committed in collaboration, provided for by Article 260 and 25 of the Penal Code”.

It is about a property with about 10,000 m2, in the center of Tirana that was privatized in 2008 with a value of 100,000 dollars. The sports club “Partizani” was owned by the Ministry of Defense, not far from the center of Tirana, where today 17 towers have been erected.
