The Court of Appeal decided not to accept Enkelejd Alibeaj’s complaint about the seal of the Democratic Party, thus giving the signature and logo of the official Democratic Party to  fomer Prime minister of Albania, Sali Berisha.

By not accepting the appeal of Alibeaj, the Court of Appeal has left in effect the decision of the First Instance, of judge Agron Zhukri, which recognizes the decisions of the Assembly of December 11, held by Re-establishment.

This decision means that the chairman of the official Democratic Party is former Prime Minister Sali Berisha, who is under the security measure “House Arrest” after the investigations initiated by Special Prosecutor’s Office (SPAK).

The decision of the Appellate panel was given by judges Alma Ahmeti, Iliba Bezati and Elona Toro. This decision is final.

At the beginning of the session, Reestablishment presented a preliminary request to reject Alibeaj’s appeal under the claim that they were not legitimate as a party.

The legal representative, Ivi Kaso, requested the enforcement of the “Zhukri” decision and the recognition of the decisions of the National Assembly of December 11, 2021, which the court supported.

“The right of annulment belongs only to the party that set the court in motion”, said Kaso.

After the decision, Sali Berisha reacted through a Facebook status.

Through his post, the chairman of the Democratic Party thanked all the democrats who supported him in the December 11 assembly. He said that this is not just a victory for him, but for democracy. He also states that the door of the Democratic Party is open to all those who think differently.
