Berisha’s request for the exclusion of constitutional judge Marsida Xhaferllari from consideration of the appeal for the mandatory security measure is dismissed as unconstitutional.
The head of the Democratic Party, Sali Berisha, claimed that Xhaferllari, as the cohabitant of Enkelejd Alibeaj, was in a conflict of interest, so she should not participate.
On November 19, the Constitutional Court is expected to consider Berisha’s appeal against the measure of obligation to appear imposed on him by SPAK.
According to Berisha’s defense team, this measure is considered unconstitutional as Prosecutor’s Office should have requested authorization from the Assembly, because the measure includes the restriction of its freedoms.
