Building maintenance will have new rules

Buildings and residential complexes will be administered with new rules.

A draft law put out for public consultation establishes punitive measures for residents who do not pay maintenance dues.

The new rules come as a result of the non-implementation of the existing 2009 law.

Apart from the Municipality of Tirana, which has managed to create a functional structure, other municipalities have encountered problems and disagreements regarding the administration.

Each co-owner pays a monthly fee to cover maintenance costs for common areas such as stairs, elevators, lighting and more.

In a building, the owners share responsibility for the maintenance of the common property. Therefore, in case an owner or tenant acting on his behalf causes damage in these spaces, he will be responsible for repairing the damage caused.

The draft law also provides for the establishment of a reserve fund, in case of emergencies.

Regarding the role that the municipalities will have, the latter will keep a register, with detailed information on the main characteristics of the property and the way of its administration.
