The Electoral Panel for Complaints and Submissions (PZAP) has annulled the decision of the Central Election Commission and ordered it to certify the political party, Serbian List, for the February 9 parliamentary elections.
“The notification of the Central Electoral Commission, dated 23.12.2024, is canceled and the CEC is ordered to certify the political entity Lista Serbe and the candidates of this political entity, according to the recommendation of the Office for Registration, Certification and Financial Control of political entities in the CEC dated 22.12.2024, for the elections for the Assembly of the Republic of Kosovo to be held on February 9 2025”, it was said in the decision published by PZAP.
In the decision published on December 25, PZAP said that the Office for Registration, Certification and Financial Control of Political Entities had recommended that the Serbian List be certified after submitting the documentation in accordance with the Law on General Elections and other CEC rules. -‘s.
So, according to the decision, Serbian List has met the criteria after submitting the “political statement”, the list of candidates and the application for each candidate, and for this party the Office for Registration and Certification has received the information from the institutions responsible for the verification of parties, as required by The law on general elections.
The panel of judges, consisting of presiding judges Arsim Hamzaj, Kujtim Pasuli, Hidajete Gashi-Alaj and Bujar Muzaqi, said that according to the Law on Elections, “the CEC certifies the political entity with the right to participate if it submits the application submitted to the prescribed form and on the date set by the CEC rules”.
“In this particular case, the Panel confirmed that the Serbian List submitted the completed application, in accordance with Articles 16 and 17 of the Law on General Elections, and the CEC is obliged to certify any political entity that meets the prerequisites legal, as completed in this case by the Serbian List, for which the same has been recommended for certification by the Office for Registration, Certification and Financial Control of Political Subjects in the CEC- it was said in the decision of the PZAP, the panel where Serbian List filed a complaint the day before.
