President of Kosovo, Vjosa Osmani, stated that if the Assembly is not constituted soon, she will refer the matter to the Constitutional Court to request clarification on what happens after the 30-day deadline expires.
According to Osmani, it is necessary to clarify the legal consequences of “failing to fulfill the constitutional obligation of constituting the Assembly.”
Referring to the Constitutional Court’s ruling on secret voting, Osmani acknowledged that it has led to many interpretations, but noted that her legal team has already reviewed it.
Speaking to journalists after the graduation ceremony for cadets, Osmani said she will continue meeting with political parties throughout the day. She emphasized that the deadlock over the voting method is irrational.
“First of all, I haven’t finished the meetings yet — there are still some political parties I will meet today because I wanted to listen individually to each party, regardless of how many MPs they have in parliament. As you know, the constitution of the Assembly depends on the will of each MP of the Republic of Kosovo. We’ve had good meetings, but naturally the main parties still have diametrically opposed positions. That doesn’t mean there won’t be progress within this timeframe. There are areas where agreement may be reached, and I hope that happens, because I believe the current deadlock over the voting method is highly irrational,” Osmani declared.
The President also stressed during her meetings with party leaders that “when something is constitutionally mandatory, failure to fulfill it cannot go without consequences.”
She warned that if the ninth legislature of the Assembly is not constituted soon, she will ask the Constitutional Court for an official interpretation.
“If the Assembly is not constituted very soon, I plan to submit a request to the Constitutional Court for clarification on what happens after the 30-day deadline. It must be clarified what the legal consequences are for not fulfilling the constitutional obligation to constitute the Assembly within 30 days. There must be legal consequences. I will speak more once I’ve concluded meetings with political parties — both regarding the content of those meetings and the plans we have for the days ahead,” Osmani concluded.
