Albanian government revises property law

Government has revised the property law to close the process started 30 years ago. With the latest change, vacant properties will be returned to former owners without restriction, while for land occupied by constructions, owners will receive compensation.

Vacant properties will be returned without restriction to the old owners. The government has intervened again in the 2015 law on the treatment of property, to accelerate and finally solve the problem of 27 thousand claimants of properties confiscated by the communist regime. The changes in law, although delayed in time, already have logic in the treatment of property, since the land or plot will return to the owner, while in areas built without permission, the former owners will receive compensation in Lek, no less than 10% of the current value.

The recommendations given by the European Court of Human Rights in the decision “Beshiri against Albania”, and the Decision of the Constitutional Court in 2021 have opened the way for the revision of the law, and will now start the administrative procedure for the unprocessed files, where they are invited 7000 owners to send the documents to the Property Agency.

The Property Agency also invites the entities that have addressed the Court of First Instance for unresolved requests for the recognition or financial evaluation of the property, to waive the judgment of the case and submit a request to the Property Handling Agency for the review of their file.

According to the government, the financial assessment made so far for 20 thousand requests amounts to 101 billion ALL, while only 974 decisions have been liquidated.
