Prime Minister Edi Rama, speaking on the podcast “FLASIM,” addressed the issue concerning Deputy Prime Minister Belinda Balluku, announcing that on Monday he will undertake a legal initiative. According to him, the initiative will first be presented to the Parliamentary Group and will be transparent to the public.
“The court, in exercising its powers, has the right to impose security measures on any person under investigation. However, at the same time, there are certain functions — including that of a minister — that become paralyzed if the minister is suspended. So if you say that I suspend a minister, the President, etc., in fact you produce an immediate consequence equal to dismissal.
Because it is not simply the person who is suspended, but the function. Precisely because of the function, the appointment or dismissal of a minister is nowhere — in no country in the world — a competence of a prosecutor or a judge through a preliminary hearing. The independence of the judiciary ends where the independence of the other two powers begins: the legislative and the executive.
Nevertheless, we will go beyond the specific case and on Monday, together with the head of the parliamentary group, Taulant Balla, and the chair of the Committee on Legal Affairs, Ulsi Manja, we will submit the initiative to immediately address the aforementioned gap. The initiative will first be presented to the parliamentary group and will be transparent to public opinion,” he said among other things.
