Fredi Beleri has asked the Administrative Court of Tirana to suspend the decree of President Bajram Begaj for the announcement of elections in the municipality of Himara.
On July 5, President Begaj decreed August 4 as the date for new elections in Himara, immediately after the CEC decided to remove Beleri’s mandate as mayor of Himara.
Beleri has opposed this decision and has asked the Administrative Court of First Instance of Tirana to suspend the implementation of the presidential decree until a final decision is made. This request is based on the provisions of the Constitution of the Republic of Albania, the Electoral Code and the Code of Administrative Procedures.
The request that has been sent to the court, a copy of which has been distributed in the media, has as its object. Obtaining the insurance measure of the lawsuit. Suspension of the implementation of Decree no. 244, dated 05.07.2024 of the President of the Republic until the final decision is taken.
Beleri was arrested on May 12, 2023 and is currently serving a prison sentence for active corruption in elections, based on the decision of the Special Court of First Instance for Corruption and Organized Crime. The two-year prison sentence was also confirmed by the Special Court of Appeal for Corruption and Organized Crime.
BELERI’S REQUEST:
This individual administrative act will be opposed by the petitioner with a Lawsuit addressed to the competent Court, as it contradicts the Constitution, the Electoral Code, as well as the Code of Administrative Procedures.
Before filing the lawsuit, the petitioner addresses the Court with a request for securing the lawsuit, suspending the implementation of the administrative act, Decree of the President of the Republic no. 244, dated 05.07.2024 of the President of the Republic until the final decision is taken”
Petitioner Dhionisios Alfred Beleri is currently the Elected Mayor of Himara Municipality, a quality that according to the law he will keep until the 30-day deadline for filing an appeal against decision no. 69 dated 05.07.2024 of the State Commissioner of Elections, or until the announcement of the decision that will examine his appeal, against decision no. 69 dated 05.07.2024 of the State Election Commissioner, in accordance with Article 164/2 of Law no. no. 44/2015 Code of Administrative Procedures.
This is because the citizen Dhionisios Alfred Beleri holds the valid Mandate of the Elected Mayor of the Himar Municipality, a mandate won in the elections of May 14, 2023, and which is currently valid, as long as the decision of the State Election Commissioner, no. 69 dated 05.07.2024 with which at the same time, this administrative body declared the Mandate invalid but also announced its premature termination, was announced on 05.07.2024, and an appeal is allowed against it, and as such this act is unenforceable in the sense of articles 133/1 and 164/2 of law no. 44/2015 Code of Administrative Procedures was announced on 05.07.2024, and an appeal is allowed against it, and as such this act is unenforceable in the sense of articles 133/1 and 164/2 of law no. 44/2015 Code of Administrative Procedures.
