CoE appoints Lulzim Basha as rapporteur for Russians’ assets confiscation

Committee for Political Affairs and Democracy in the Parliamentary Assembly of the Council of Europe has voted unanimously today to appoint the chairman of the Democratic Party, Lulzim Basha, as the rapporteur for the confiscation of Russian assets and their use for repairing the damage caused by Russia’s aggression against Ukraine.

Earlier, DP chairman Lulzim Basha presented a draft resolution to the Council of Europe calling for the confiscation of Russian assets, the creation of an international fund to deposit the confiscated assets, and making these funds available for financing Ukraine’s reconstruction projects.

A similar proposal is being discussed in the American Congress, while the President of the European Commission, Ursula von der Leyen, has requested that Russia and its oligarchs should compensate Ukraine for the damage and cover the costs for the reconstruction of the country.

Draft resolution presented by the chairman of the Democratic Party Lulzim Basha:

Responsibility for the crimes and damage caused in Ukraine by Russia’s unprovoked aggression lies with the President of Russia, Vladimir Putin, and he must pay for it.

While the International Criminal Court has issued an arrest warrant for Putin, accusing him of war crimes, Russia must now pay for the reconstruction of Ukraine destroyed by Russian bombing.

Under international law, the Russian Federation has the obligation to compensate Ukraine, its citizens, enterprises and government, for damages caused by the illegal acts of the Russian Federation. These obligations define the duty of third countries to ensure that the sovereign assets of the Russian Federation located under their jurisdictions to be settled in favor of Ukraine as well as to establish an international compensation tribunal to ensure that damages caused by Russia are compensated in accordance with international norms, jurisprudence and established accounting principles.

Through this resolution published on the official website of the Council of Europe, which is supported by representatives of all parliamentary groups, it is requested:

Creation of an international fund where the assets of the Russian Federation will be deposited to pay for infrastructure projects in Ukraine;

Transfer of frozen capital of the Russian Federation to the international fund;

Establishment of a compensation tribunal to adjudicate, in accordance with established judicial norms, claims submitted by Ukraine on behalf of individuals, entities and governmental bodies, or directly by its individuals and entities, as shall be provided by the rules of the tribunal.
