Constitutional Court quashes 1% threshold for independent candidates

The Constitutional Court has partially accepted the request of Elton Debreshi, one of the independent candidates from the April 25 general elections, to revoke the 1% electoral threshold required for the election of free runners.

In an announcement released on the official website, the Court clarified that Article 162 (1) of the Electoral Code, on candidates nominated by the electorate placing equal limitations with candidates nominated by a political party, or by a coalition of a political party, undermines the constitutional right to be elected, based on juridical equality and anti-discrimination principles.

Accordingly, the Constitutional Court decided to nullify the part that evens candidates proposed by voters to candidates proposed by the political parties, or by a coalition of political parties.

The 1% electoral threshold prescribed by the Electoral College stipulates that apart from the necessary votes to pass the threshold in a respective county, the candidates must also receive more than 1% of the national ranking.
