After the letter sent by the Government of Kosovo to the Parliamentary Assembly that they will draft a new Statute of the Association by the end of May, a very strict letter has arrived to the Prime Minister of Kosovo, Albin Kurti from the heads of the three most powerful states of the EU of: France, Germany and Italy.
First of all, it is said that Kosovo risks membership in the Council of Europe if it does not take steps towards the Association, while its proposal for the draft of a Statute is called “inappropriate and unenforceable” in the context of consultations with mayors and assemblies of municipalities in the north without political legitimacy.
“Your actions and decisions at this critical moment will be decisive for Kosovo’s aspirations for membership in the Council of Europe. The ball is in your court. We sincerely believe in your leadership”, said the three heads of European states to Albin Kurti, write the media in Kosovo.

Secondly, submitting this draft to the experts of the Council of Europe would not constitute a necessary decisive step as their opinion will not be legally binding. This can only be achieved by sending it to the Constitutional Court of Kosovo, so that it is admissible to the Court. As clarified with Brussels, there are no legal obstacles in the EU-facilitated Dialogue to take this step.
Thirdly, your proposal for the preparation of a new draft in consultation with the current mayors or deputies of the municipalities is neither suitable nor applicable for the current circumstances in these municipalities”.
