New Whistleblower Law, Protection for Employees Who Report Corruption

The Albanian government has proposed a new law on whistleblowers with the aim of protecting employees who report corruption and legal violations in the public or private sector.

The government has submitted to Parliament a new draft law designed to strengthen the whistleblowing system and the protection of individuals who report corruption or breaches of the law.

The draft law, deposited in Parliament by Socialist MP Erion Malaj, foresees the establishment of a unified whistleblowing mechanism within institutions.

Public institutions and private entities with more than 50 employees will be required to create special structures for receiving, reviewing, and managing whistleblowing reports.

Any person who reports a violation will enjoy strong legal guarantees against retaliation. The law prohibits actions such as dismissal or suspension for employees who have reported a legal violation.

The draft law stipulates that employees of institutions involved in procurement procedures—as well as other individuals who become aware of irregularities—may report cases related to the manipulation of tendering processes.

It is emphasized that whistleblowing is particularly important for the protection of European Union funds, which are used in public projects, economic development, and infrastructure investments.

With the approval of this law in Parliament, the 2016 law “On Whistleblowing and the Protection of Whistleblowers” will be repealed.
