SPAK wants to resume the trial against former defense minister Fatmir Mediu and his alleged involvement in the Gerdec explosion that left 26 people dead.
The Special Prosecution revoked a 2009 ruling to drop the case against Mediu since he had diplomatic immunity at the time.
The Special Appellate Court will review SPAK’s request on September 17.
Earlier on, the Special Court against Corruption and Organized Crime quashed SPAK’s retrial request, arguing that no new evidence had been presented and that the prosecution had sufficient time to investigate the case since immunity for lawmakers was lifted in 2012.
SPAK has called for a reinvestigation on Fatmir Mediu, accusing the former official as one of the key people involved the tragedy.
Legal feud background
Earlier on, as the case reopened, the High Court announced that it didn’t have the authority to deal with the suit and shifted competencies to the Special Court against Corruption and Organized Crime.
The shift came shortly after the Special Prosecution called on the High Court to reopen the case against the former defense minister.
In 2009, Mediu was acquitted as he was an MP and was shielded by parliamentary immunity.
The powerful blast, just 11 kilometers northwest of the capital, claimed the lives of 26 workers, who were mainly locals and hence lacked the knowledge to handle the complex process of dismantling obsolete ammunition.
