Gerdec tragedy, SPAK calls for reopening of criminal trial against former minister Fatmir Mediu

The Special Prosecution Against Corruption and Organized Crime, alias SPAK, has called to reopen investigations against then Minister of Defense Fatmir Mediu over the deadly explosion that took place 13 years ago at an ammunition dismantling plant in Gerdec which claimed the lives of 26 citizens.

SPAK filed the request to the High Court which decided to drop the criminal trial against Mediu in 2009 as he had parliamentary immunity.

“The legal argument why the Criminal College of the High Court with the decision no.6, dated 09/04/2009 decided to rest the criminal case against citizen Fatmir Mediu, existing parliamentary immunity, is no longer in the criminal procedures legislations”, argued SPAK.

Parliamentary immunity legislation incurred changes in 2012 and 2017 related to the way on how MPs are investigated and/or tried.

“The Special Prosecution considers that the criminal prosecution in the case against Fatmir Mediu has no reasons why it should not proceed as the obstruction of the authorization for the proceedings was only temporary at the time when it was decided to rest the case, while now this impediment no longer exists”, announced SPAK.

The decision of SPAK comes after a family’s plea to reopen the criminal prosecution against minister Mediu, after losing their 7-year-old child in the tragedy.

The deadly blast claimed the lives of 26 people, with other hundreds injured by the strong explosion and flying debris.
