The losses in the Arbitration Courts began in 2003 when the government led by Prime Minister Fatos Nano, awarded the American company “General Electric” the contract for the construction of the Tirana-Durres railway line, known as the electric train.
After the political rotation in 2005, the government led by the former prime minister, Sali Berisha, unilaterally canceled the contract. In 2007, the Court of Rome in Italy left the responsibility to the Albanian government for unilateral breach of the contract, punishing it with 20 million dollars.
The money was not collected by the treasury at the time, but the American company, like Becchetti today, seized Albania’s income from Eurocontrol, the European air traffic monitoring network.
“This type of performance and this type of behavior of the state, whether through the settlement of contracts, without receiving a specialized opinion, I am convinced that it has been a source of conflict and has been used by foreign operators to turn the outcome of the judgments in their favor” – says Fatos Lazimi, former member of the Court of Arbitration, ICC Paris
