The Constitutional Court has left in full force the Property Compensation Law of 2022. During this Tuesday’s session, all the demands of the Albanian Muslim Community (KMSH) were dismissed.
The decision-making of the Constitutional Court guarantees the implementation of the decision of the European Court of Human Rights (ECtHR BESHIRI) against Albania. According to this decision, the 10% threshold is guaranteed for cases of compensation for owners whose cadastral item has changed.
The Albanian Muslim community demanded in the lawsuit the annulment of some articles of the law amended in October last year, as well as a series of decisions of the Council of Ministers, which were issued before and after these changes in implementation of this law.
In other words, KMSH said that the 2022 law does not guarantee the 10% set by the ECtHR, which it said in 2021 for Albania when it comes to compensation.
The ECtHR had said that the state would compensate according to the value not of their market that changed the cadastral area, but according to the value at the time of the change, and the compensation should be no less than 10 percent.
The Constitutional Court said today that 10% is guaranteed.
