The Constitutional Court has decided to send the case of the disputed legitimacy of the 2019 local elections back for re-examination, settling on November 2, as the new court date.
In the notice shared today with the local press, the Constitutional clarified that following the arrival of the report from the Venice Commission, the Court decided that a public plenary session had to be reopened.
In June, the Constitutional Court asked the Venice Commission for a specialized opinion on the disputed legitimacy of the 2019 local elections, which were held without the participation of the opposition in the race.
The lawsuit that followed was filed by the National Association of Municipalities led by the mayor of Shkodra, Voltana Ademi, who asked to have the elections nullified.
The Constitutional responded by saying that the next step had to be sending a formal request to the Venice Commission, arguing that this lawsuit was unprecedented and that it represented a unique case in the Albanian justice system.
In their formal opinion made public a few days ago, the Venice Commission said amongst others that the Constitutional Court lacks the competence to decide about the probable legitimacy or lack thereof, of the local elections, held on June 30, 2019.
