Gender equality and hate speech, new Code of Broadcasting implements stricter measures

The newly enacted Code of Broadcasting introduces stringent measures for audiovisual broadcasters who violate the regulations. As per the law, broadcasters may face fines of up to 400,000 Albanian lek for any breach of the code, particularly in cases related to discrimination, gender equality, or the promotion of hate speech.

The recent codification for television broadcasts, which came into effect this month, marks a significant step forward, as it places special emphasis on preventing gender discrimination in all its forms. The code now actively promotes gender equality, striving for a balanced representation of genders in various programs. Furthermore, it addresses the issue of sexism in audiovisual media, ensuring that content does not provoke gender-based discrimination or incite violence.

Among the key highlights of the new code are enhanced protections for children in all types of programming, as well as greater safeguards for the rights and accessibility of individuals with disabilities. The goal is to ensure that all television broadcasts adhere to ethical standards and uphold fundamental rights. Additionally, the code provides broadcasters with clear guidelines to appropriately assess and address events or characters featured on television, in compliance with the law.

The creation of the new Code of Broadcasting was the culmination of a year-long effort by the Complaints Council, which initiated a comprehensive public consultation across all regions of the country. During this process, representatives from television networks, civil society organizations, central and local institutions, and local and international partners engaged in extensive discussions and offered their insights.

The revised code was further scrutinized by experts from the Council of Europe and the Organization for Security and Co-operation in Europe (OSCE), who closely monitored the entire process and provided their input.

The new Code of Broadcasting seeks to strike a careful balance by considering the perspectives of all stakeholders, aligning with evolving local and international legal frameworks, and incorporating recommendations from local and foreign experts. Ultimately, the code aims to meet the needs and standards of the Albanian audiovisual market, ensuring responsible broadcasting practices that promote fairness, equality, and respect for all viewers.
