High Court has just overturned former defense minister’s, Fatmir Mediu, recourse which was brought up to counter the verdict of the Special Appeals Court, which accepted SPAK’s request to reopen the Gerdec files.
Through a defense team, Mediu made the argument that this verdict was in violation of the law on the principle of reopening a closed case.
Earlier, the former defense minister had declared that he would be taking the case to the Court of Strasbourg. Mediu has also emphasized that his responsibility as minister came as a result of the decision of the Council of Ministers.
The case against the former minister was reopened by Zamira Dudaj, who lost her son in the incident that took place in Gerdec.
Initially, the First Instance Special Court overturned SPAK’s request to retry Mediu, after making the argument that all legal deadlines had been overpassed and the case couldn’t be retried if no new evidence was presented.
The Court had also argued that Mediu’s lack of immunity, especially after 2019, hadn’t prevented the Prosecution from starting proceedings against him.
In the massive explosion that took place in the detonation center in Gerdec on March 15, 2008, 26 people lost their lives and 300 others were injured.
