Human rights violations during the pandemic, jurists present pro and con arguments

“When faced with a difficult situation, in cases like the COVID-19 pandemic, these types of restrictions on basic human rights and freedoms are reasonable”.

This argument was made during Euronews Albania’s ‘Morning’ show, by attorney Xhon Skenderi, who commented on issues related to human rights during the pandemic and mandatory vaccination.

Professor of the Faculty of Law underlined that “in cases when the procedural and material conditions of the convention on mandatory vaccination are respected, then we can’t talk about a violation of human rights”.

The attorney also explained that when a product is certified, it can be used on citizens seeing that the legal aspect is taken into account.

“We aren’t dealing with an experiment, but a certified product,” – he added.

On the contrary, attorney Megi Kurti said that mandatory vaccination can be legitimate only for a specific category of people.

The Faculty of Law professor declared that if a certain case goes to court, then it is definitely up to each country to decide for itself.

According to her, all other measures must be put to practice before we can talk about mandatory vaccination.

“One of the issues that arise from mandatory vaccination is the fact that if you make it obligatory, you are forcing people that don’t wish to get vaccinated to try and find alternative ways to get ahold of the vaccination passport,” – she argued.
