Albania to address Venice Commission on extending vetting mandate

Albania will ask for an opinion from the Venice Commission over constitutional amendments required for extending the mandate of vetting bodies.

The request was granted during a joint meeting held between the Legislation Council and the parliamentary committee on legal affairs, although it was largely voted by the ruling parliamentary majority.

Socialist MP and former interior minister Fatmir Xhafaj abstained.

The majority has been demanding to extend the mandate of the vetting bodies, as the term of the Independent Qualification Commission (KPK), including the Public Commissioner, expires in June 2022.

In that scenario, as per the Constitution, cases must be delegated to the High Judicial Council and the High Prosecutorial Council.

Extending the mandate of the new judicial bodies cannot be achieved without the input of the opposition, as a total of 94 votes are required.

The Venice Commission’s opinion is non-binding and it will still be up to MPs to vote on whether to extend the mandate.
